1. Introduction

1.1 Welcome to Cardii. Cardii is a multi-vendor car rentals, car sales, and driver rentals app that connects buyers, renters and vendors.

1.2. These Terms and Conditions ("Terms") govern the use of our mobile application and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. 

2.0 Definitions

2.1 "App" means the Cardii mobile application (Cardii platform) or website. 

2.2 "Vendor" means the individual or entity providing vehicles for rent or sale.

2.3 "Renter" means the individual or entity renting a vehicle.

2.4 "Buyer" means the individual or entity purchasing a vehicle.

2.5 "User" means a Renter or a Buyer.

2.6 "Driver" means any qualified individual approved to drive a vehicle on our platform. 

2.7 "Vehicle" means the car or other vehicles listed on our App.

3. Eligibility

3.1 You must be at least 18 years old and possess a valid driver’s license to rent a car on our platform. 

3.2 You must be at least 18 years old to rent a driver or purchase a car through our platform. 

3.3 By using Cardii, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all the Terms and Conditions.

4. Account Registration

4.1 To access our Services, you must register for an account.

4.2 You must provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.3 You are responsible for safeguarding your account information and are liable for any activity that occurs under your account.

5. Vehicle Rentals

5.1 The rental agreement is a contract between the user (renter) and the vendor (car owner).

5.2 Cardii acts as a facilitator and is not a party to the rental agreement.

5.3 All rental terms, including pricing, duration, and conditions, are determined by the vendor.

5.4 Users are responsible for returning the vehicle in the same or better condition as when rented.

3.5 Users are responsible for any damage, loss, or theft of the vehicle during the rental period.

6. Vehicle Sales

6.1 The sales agreement is a contract between the buyer and the vendor (car owner).

6.2 Cardii acts as a facilitator and is not a party to the sales agreement.

6.3 All sales terms, including pricing, payment, and conditions, are determined by the vendor.

6.4 Sellers and Buyers must ensure they have all necessary documentation and meet all legal requirements for purchasing a vehicle.

7. Driver Rentals

7.1 The driver rental agreement is a contract between the user (hirer) and the vendor (driver).

7.2 Cardii acts as a facilitator and is not a party to the driver rental agreement.

7.3 All driver rental terms, including pricing, duration, and conditions, are determined by the driver.

7.4 Users (hirers) are responsible for the conduct and safety of the driver during the rental period.

8. Towing Vendors & Roadside Assistance.

8.1 The towing or roadside assistance agreement is a contract between the user (hirer) and the towing company.

8.2 Cardii acts as a facilitatorand is not a party to the towing or roadside assistance agreement. 

9. Payment Terms

9.1 All payments are processed through the Cardii platform.

9.2 Payment methods accepted include credit cards, debit cards, mobile money and other payment methods as specified on the platform.

9.3 A security deposit may be required by the vendor and will be held according to the vendor's policies.

10. Cancellation and Refunds

10.1 Cancellation policies are set by each vendor and will be outlined in the rental or sales agreement.

10.2 Refunds, if applicable, will be processed according to the vendor's cancellation policy.

11. User Responsibilities

11.1 You agree to use the Services only for lawful purposes and in accordance with these Terms.

11.2 You agree to provide accurate information and to update it as necessary.

11.3 You are responsible for complying with all applicable laws and regulations of the applicable country of which Cardii conduct business.

12. Vendor Responsibilities

12.1 Vendors must provide accurate descriptions and conditions of their cars and driver services.

12.2 Vendors must ensure their vehicles are safe, cleaned and well-maintained, and in good working condition.

12.3 Vendors must ensure that drivers are qualified and have valid licenses and necessary documentation.

13. Prohibited Activities

13.1 You may not use the Services for any unlawful purpose or in violation of any local, state, national, or international law.

13.2 You may not use our Services or platform to defraud or mislead others.

14. Liability

14.1 Cardii is not liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with your use of the Services.

14.2 Vendors are solely responsible for any claims, damages, or liabilities arising from their cars, rental agreements, and driver services.

15. Dispute Resolution

15.1 Any disputes between users and vendors should be resolved between the parties involved.

15.2 Cardii may offer assistance in dispute resolution but is not obligated to mediate or resolve any disputes.

16. Termination

16.1 Cardii reserve the right to terminate or suspend your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

17. Changes to Terms

17.1 Cardii may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the platform. You are advised to review these Terms periodically for any changes.

18. Governing Law

18.1 These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Cardii operates, without regard to its conflict of law principles.
